Terms of Service

These Terms of Service ("Terms") govern your access to and use of the dyto platform at dyto.ai and related services (the "Service") operated by Angels Dice Ltd ("we", "us", or "dyto"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you are at least 16 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@dyto.ai if you suspect unauthorised access. We are not liable for losses arising from unauthorised use of your account.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights.
  • Generate, distribute, or store content that is unlawful, defamatory, obscene, or harmful.
  • Attempt to gain unauthorised access to the Service, other accounts, or related systems.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated means (bots, scrapers) to access the Service beyond the provided API, unless explicitly authorised.
  • Resell, sublicence, or redistribute the Service without our written consent.

We reserve the right to suspend or terminate accounts that violate these terms.

4. AI-Generated Content and Ownership

The Service uses artificial intelligence to help you create social media content, including text, images, and schedules.

  • Your content: you retain ownership of all content you create using the Service, including AI-generated outputs based on your inputs and brand settings.
  • Our licence: you grant us a limited licence to host, process, and display your content solely to provide and improve the Service.
  • No guarantees: AI-generated content is provided "as is". You are responsible for reviewing and approving all content before publishing. We do not guarantee that AI outputs will be accurate, original, or suitable for any particular purpose.

5. Subscription and Billing

  • The Service offers free trials and paid subscription plans as described on our pricing page.
  • Paid subscriptions are billed in advance on a monthly or annual basis through Stripe.
  • All fees are non-refundable except where required by law or as stated in our refund policy.
  • We may change pricing with at least 30 days' notice. Price changes take effect at the start of your next billing cycle.
  • If payment fails, we may suspend access to paid features after a reasonable grace period.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Angels Dice Ltd and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other proprietary materials beyond what is necessary to use the Service.

8. Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
  • Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
  • We are not responsible for content published to third-party platforms through the Service, including any consequences of posting AI-generated content.

9. Indemnification

You agree to indemnify and hold harmless Angels Dice Ltd, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

10. Termination

You may cancel your account at any time through the account settings or by contacting us. We may suspend or terminate your access if:

  • You breach these Terms.
  • Your account has been inactive for an extended period.
  • We are required to do so by law or to protect the rights and safety of others.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice on the Service at least 14 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
